The County’s Mobility Fee Ordinance requires that mobility fees be collected for all new development to fund the construction of necessary road improvements attributable to growth. To calculate mobility fees, Clay County is divided into five different districts. The rates for land uses within each district have been determined by a Mobility Fee Study, which considers the amount of available roadway capacity and the specific roadway impacts of individual land uses.  Please click the mobility fee link below for the district maps and corresponding rate schedules.

School Impact Fees serve a similar function to defray the cost of growth’s impact on the County’s school system in ensuring that adopted service levels can continue to be met.  These fees are uniform throughout the County and are assessed solely upon residential development by type. The County’s Comprehensive Impact Fees, effective June 1, 2023, will be collected for new commercial and residential development.  All fees are applicable to development in the unincorporated areas of the County and certain fees are also applicable in designated municipalities. New commercial development will be subject to a Government, Jails and Constitutional Facilities Impact Fee, a Fire and Rescue Facilities Impact Fee and a Law Enforcement Facilities Fee. New residential development will be subject to a Government, Jails and Constitutional Facilities Impact Fee, a Fire and Rescue Facilities Impact Fee, a Law Enforcement Facilities Fee, a Community Park Impact Fee, a Regional Park Impact Fee and a Library and Cultural Facility Impact Fee. These funds  will be utilized to help fund facilities deemed necessary to support government services required due to increased growth in the County.  Please click on the facility impact fee link below to view the rate schedule and applicable areas for those fees.

The Mobility and Impact fees are assessed when a building permit is issued and must be paid before scheduling a final equipment check.

Mobility Fee and Impact Fee exemptions are allowed only through an action that does not create an additional dwelling unit. If a home is replaced, moved from one lot to another, or if a home is destroyed and then replaced, it may be eligible for a fee exemption. The owner of a parcel of land may be exempt from paying a fee if there is an existing dwelling unit on the property listed on the tax roll. That dwelling must be removed and replaced with another dwelling unit. To be exempt from the school impact fee, the dwelling must have been on the tax roll after May 1, 2003. Property tax data is available through the Tax Collectors public website for a span of 10 years.  Following that time, the burden of proof to provide documentation demonstrating the existence of a tax assessed dwelling on a property falls to the property owner.  To be exempt from the mobility fee and the facilities impact fees, a dwelling must have been listed on the tax roll within the immediate, past five years.

To obtain an exemption, a homeowner should complete the Impact Fee Exemption Request Form and return the form to the County’s Special Projects Coordinator, along with supporting documentation referenced in the application. The owner must request the exemption or provide a notarized letter of authorization if someone else requests the exemption on their behalf. The exemption request should be completed before applying for the permit to replace the dwelling. Once the information on the form is reviewed, a resulting determination letter will be sent to the homeowner or authorized requestor, who must provide a copy to the Building Department when requesting their permit.

Waivers are available for Affordable and Workforce Housing that meets the requirements of the respective County Ordinances.
